has the kernel patch been applied in replicant? for which version?

I don't understand why you are opening a bug report to ask a question: this is not appropriate, use the forums instead!
The kernel versions we use are directly forked from CyanogenMod, so if CM included the patch, we should have it as well. You can check on our gitorious repos.
